Die rechtliche Unabhängigkeit der Deutschen Bundesbank, der Bulgarischen Nationalbank und der Europäischen Zentralbank

Abstract

Das Ziel der Arbeit besteht darin, durch einen Vergleich zwischen der Deutschen Bundesbank und der Bulgarischen Nationalbank, insbesondere durch den Vergleich der rechtlichen und gesetzlichen Stellung beider Banken im Staatssystem, es zu ermitteln, inwieweit das Zentralbankwesen in Bulgarien die notwendigen normativen Grundlagen besitzt, die ihm den Beitritt zum Europäischen System der Zentralbanken ermöglichen werden. Auch der Status der Europäischen Zentralbank als Teil des ESZB hat seinen Platz in der Struktur der Arbeit gefunden. Als Einführung ist eine kurze Darstellung des Zentralbankwesens und seiner Besonderheiten in wirtschaftswissenschaftlicher Hinsicht dargeboten. Es wird auf die Wichtigkeit der Zentralbanken und auf Ihre Rolle und Aufgaben in der Wirtschaft heute akzentuiert. Die gesetzliche Regelung der Zentralbanken Deutschlands und Bulgariens wird weiter ausführlich analysiert. Es wird zunächst auf die geschichtliche Entwicklung des Zentralbankwesens jeweils in beiden Ländern hingewiesen. Danach werden die eigentlichen Texte aus den Verfassungen und aus den besonderen Bankgesetzen näher betrachtet. Als Kern der Problematik erweist sich die allgemeine Frage über die Unabhängigkeit der Zentralbank von den übrigen Elementen des Staates. Die gesetzliche Lösung dieser Frage in beiden Ländern wird beschrieben und rechtswissenschaftlich untersucht. Schließlich wird auf die verschiedenen Theorien und Meinungen in der Fachliteratur eingegangen. Alle Fragen sind getrennt für die DBB und für die BNB dargelegt. Der darauf folgende eigentliche Vergleich zwischen den beiden Zentralbanken wird durch Schlußfolgerungen und Feststellungen bezüglich der künftigen Entwicklung der BNB beendet. Die beigefügte kurze Übersicht der Regelung der EZB dient dazu, den Zweck der gesamten Arbeit besser zu veranschaulichen. Als Ergebnis wird festgestellt, daß die Zentralbank Bulgariens in fast allen Hinsichten vorbereitet ist, die Verantwortlichkeiten einer Mitgliedschaft am ESZB zu übernehmen.

The object of this work is, through a comparison between the German Federal Bank (Deutsche Bundesbank) and the Bulgarian National Bank (particularly a comparison between the legal and the statutorily position of the two central banks in the state system) to determine to what extent the central banking in Bulgaria possesses its normative base, which would allow its integration with the European Central Banks System (ECBS). The state of the European Central Bank as a leading member of the ECBS has also been included into the structure of the work. A short description of the central banking at all and its specialties in economic respect is presented as an introduction. The importance of the central banks and their role and tasks in the macroeconomics are accentuated. The statutorily regulations of the central banks in Germany and in Bulgaria are further detailed analyzed. The attention is directed first to the historical development of the central banking in both the states. The actual texts from the constitutions and from the special bank statutes are further examined after that. The core of the matter proves to be the general question about the central bank's independence of the other parts of the state. The legal answers to this question in Germany and in Bulgaria are described and juristic investigated. Finally, the different theories and views in the professional literature are considered. All the topics are separately for the German and for the Bulgarian central bank explained. The following actual comparison between the both of the central banks contains conclusions and statements about the future development of the BNB. The appended short review of the European Central bank contributes to a better illustration of the purpose of this work. In result, we find out that the Bulgarian National Bank in almost every respect is ready to assume the responsibility of a membership to the ECBS.
